Regarding the U.S. Litigation Concerning CAP-1002 (deramiocel) – U.S. Court Denies Motion for Preliminary Injunction and Refers Dispute to Arbitration –
KYOTO, Japan, August 10, 2026 – Nippon Shinyaku Co., Ltd. ("Nippon Shinyaku"; Headquarters: Kyoto, Japan; President: Toru Nakai) announced that Capricor Therapeutics, Inc. ("Capricor"; Headquarters: San Diego, California, USA; Chief Executive Officer: Linda Marbán) had withdrawn its motion for preliminary injunctive relief and its opposition to Nippon Shinyaku's motion to compel arbitration. The Superior Court of New Jersey subsequently dismissed Capricor's motion for preliminary injunctive relief, granted Nippon Shinyaku's motion to compel arbitration, and ordered that the dispute be resolved through arbitration.
As a result of the court's decision, the dispute will now proceed to arbitration in accordance with the arbitration provisions of the distribution agreement.
As previously announced in Nippon Shinyaku's news release dated May 8, 2026, entitled " Announcement of a Lawsuit Filed against Nippon Shinyaku", Capricor filed a lawsuit in the State of New Jersey seeking, among other things, termination of the U.S. commercialization agreement relating to CAP-1002 (deramiocel).
